These Terms of Service govern access to and use of the BRONXHILL website, online storefront, product pages, checkout, account features, digital delivery systems, product information, previews, renders, text, images, and related website services.

BRONXHILL is a cinematic spatial design studio providing digital products, including materials, 3D assets, environment bundles, documentation, and related digital files.

BRONXHILL products are digital products. BRONXHILL does not provide physical shipping for its standard digital products.

By using the website, creating an account, placing an order, submitting payment, accessing files, or downloading BRONXHILL materials, you agree to these Terms. Product use is also governed by the applicable BRONXHILL license agreement, order record, invoice-linked scope confirmation, product terms, or written approval.

If you do not agree, do not use the website, place an order, access files, download files, or use BRONXHILL materials.

1. Scope of These Terms

These Terms apply to access to and use of the BRONXHILL website, online storefront, product pages, checkout, account features, digital delivery systems, product information, previews, renders, text, images, and related website services.

These Terms do not grant product-use rights beyond the applicable BRONXHILL license agreement, order record, invoice-linked scope confirmation, product term, or written approval.

Where a separate BRONXHILL license agreement, order record, invoice-linked scope confirmation, product term, or signed written agreement applies to a specific product, service, transaction, or usage right, that document controls that specific product, service, transaction, or usage right.

2. Website Use

You may use the BRONXHILL website only for lawful purposes and only in accordance with these Terms.

You may browse the website, review product information, create an account where available, place orders, submit inquiries, and access digital products where authorized.

You may not interfere with the website’s operation, security, checkout systems, account systems, digital delivery systems, or other users’ access.

BRONXHILL may limit, suspend, or terminate website or account access if the website, account, order, or access is used in violation of these Terms, applicable policies, payment obligations, or applicable law.

3. Accounts and Information

You are responsible for the accuracy of information submitted through the website, including account, billing, company, project, contact, and payment information.

You are responsible for maintaining the security of your account credentials and for activity conducted through your account.

If you use the website, place an order, or request a license on behalf of a company, studio, agency, production company, brand, client, employer, or other entity, you represent that you have authority to act on that entity’s behalf.

4. Digital Products and Delivery

BRONXHILL products are digital products. They may include materials, 3D assets, environment bundles, project files, preview images, documentation, metadata, license text, and related digital deliverables.

Digital delivery may occur by download link, customer account access, email delivery, cloud-based delivery, manual delivery, or another digital delivery method selected by BRONXHILL.

BRONXHILL does not provide physical shipping for its standard digital products.

You are responsible for confirming that your software, hardware, operating system, plugins, renderers, engines, file-management systems, and intended workflow are compatible with the product before purchase.

BRONXHILL does not guarantee compatibility with any specific software, software version, operating system, renderer, engine, platform, device, production pipeline, or workflow.

5. Product Licenses

BRONXHILL products and files are licensed, not sold.

A purchase, download, file access, product listing, preview image, cart display, checkout page, invoice, email, website page, or public communication does not expand, modify, or replace the applicable BRONXHILL license.

Permitted and prohibited product uses are governed by the applicable BRONXHILL license agreement, order record, invoice-linked scope confirmation, product term, or written approval.

6. Orders, Pricing, and Payment

Prices, license fees, product availability, license availability, scope, and access may vary by product, license type, resolution, intended use, written approval, order record, invoice, and applicable BRONXHILL license agreement.

BRONXHILL may correct pricing, product, license, technical, or availability errors at any time. BRONXHILL may refuse, cancel, revise, or require correction of an order where information is inaccurate, incomplete, unavailable, or inconsistent with the applicable product or license structure.For direct-checkout digital products, access is provided after payment is received and the product is made available for access, download, or delivery.

For products, services, licenses, or transactions requiring manual review or written approval, no rights arise from inquiry, form submission, conversation, estimate, quote, proposal, draft document, invoice, partial payment, or course of dealing unless the applicable BRONXHILL approval and payment requirements are satisfied.

7. Digital Sales and Refunds

All BRONXHILL digital product purchases are final.

BRONXHILL does not offer returns, exchanges, or refunds for digital products once an order is placed, except where required by applicable law or expressly approved by BRONXHILL in writing.

This refund policy does not expand, reduce, or replace any separate rights or obligations stated in an applicable BRONXHILL license agreement, order record, invoice-linked scope confirmation, product term, or written approval.

8. Website Content and Intellectual Property

BRONXHILL original website content, product images, renders, previews, videos, text, graphics, digital presentations, and brand materials are protected by applicable intellectual-property laws. Certain third-party platform elements, tools, fonts, themes, apps, or technical components may be owned or controlled by third-party providers.

Website content is displayed for evaluation of BRONXHILL products and services. Viewing the website does not grant any ownership interest, license, product-use right, media right, reproduction right, distribution right, download right, or right to use BRONXHILL content outside the website.

BRONXHILL website content may not be copied, downloaded, scraped, crawled, extracted, saved, reproduced, republished, distributed, modified, imitated, exploited, used in public-facing materials, used in production materials, used to train or develop AI systems, or used to recreate or derive substitute products, designs, assets, materials, environments, or visual systems.

For approved product use, the applicable BRONXHILL license agreement, order record, invoice-linked scope confirmation, product term, or signed written agreement controls.

9. Prohibited Website Conduct

You may not use the website or website content to:

·       copy, scrape, crawl, harvest, mirror, archive, or systematically collect BRONXHILL content or product data;

·       interfere with website security, checkout, payment systems, account systems, digital delivery, or access controls;

·       use bots, automated tools, deceptive access methods, or unauthorized scripts to access or extract website content;

·       upload or transmit malicious code, spam, false information, or misleading account information;

·       misrepresent your identity, authority, affiliation, payment information, project information, or intended use;

·       suggest endorsement, sponsorship, affiliation, ownership, or approval by BRONXHILL where none has been expressly granted in writing;

·       use BRONXHILL website content for AI training, dataset creation, model development, automated analysis, scraping, or similar computational processing;

·       use BRONXHILL website content to recreate, imitate, or derive substitute products, materials, assets, environments, renders, layouts, or design systems.

10. Third-Party Platform Services

BRONXHILL operates its online storefront using third-party platform, payment, hosting, analytics, security, digital-delivery, and business-service providers.

Those providers operate their own systems under their own terms, privacy policies, cookie practices, technical controls, and service requirements.

BRONXHILL does not control third-party platform infrastructure, checkout architecture, payment-processing systems, cookies, tracking technologies, service availability, platform-level data practices, or third-party service-provider systems.

BRONXHILL remains responsible for BRONXHILL product descriptions, BRONXHILL license terms, BRONXHILL digital-product policies, and BRONXHILL customer-facing representations.

Use of the storefront may involve processing by third-party service providers as necessary to operate the store, process transactions, provide account features, support digital delivery, maintain security, comply with law, and administer BRONXHILL licenses.

11. Privacy

BRONXHILL’s collection, use, and handling of personal information is described in BRONXHILL’s Privacy Policy.

Personal information submitted through or collected in connection with the website, storefront, checkout, account features, payment processing, digital delivery, analytics, cookies, and related services may be processed by BRONXHILL, payment processors, and other service providers involved in operating the storefront.

Third-party service providers may also process personal information through their own platform systems, tools, cookies, analytics, security functions, payment systems, and service infrastructure under their own terms, privacy policies, and platform controls.

12. Product Information and Availability 

BRONXHILL may update, revise, discontinue, rename, repackage, remove, or limit any product, service, license option, feature, product page, or website content at any time.

Product images, renders, previews, colors, lighting, material appearances, scale impressions, and visual results may vary based on software, renderer, lighting, UVs, device settings, color management, compression, file handling, and user workflow.

BRONXHILL may correct errors, inaccuracies, or omissions relating to product descriptions, pricing, license references, availability, file formats, compatibility notes, or delivery information at any time.

13. Professional and Technical Responsibility

BRONXHILL digital products are provided for professional digital workflows and license-based use.

You are responsible for reviewing, testing, validating, and implementing BRONXHILL products within your own software environment, technical workflow, project requirements, client requirements, and production pipeline.

Unless expressly stated in a separate written agreement, BRONXHILL digital products are not construction documents, permit documents, engineering documents, shop drawings, fabrication instructions, manufacturer specifications, or physical build instructions.

14. Feedback and Submissions

Do not submit confidential, proprietary, or unsolicited creative ideas unless BRONXHILL has expressly requested them under a separate written agreement.

If you submit non-confidential feedback, comments, corrections, suggestions, reviews, or operational input about the website, products, or services, BRONXHILL may use that feedback for business, product, legal, operational, and service-improvement purposes without compensation or obligation to you.

Submitting feedback does not create an ownership claim, authorship claim, approval right, confidentiality obligation, partnership, employment relationship, or license expansion.

15. Disclaimers

The website, storefront, digital delivery systems, product pages, previews, renders, documentation, and related website services are provided “as is” and “as available.”

BRONXHILL does not guarantee that the website, checkout, account features, downloads, third-party services, product pages, or digital delivery systems will be uninterrupted, error-free, secure, permanently available, or compatible with your systems.

To the fullest extent permitted by law, BRONXHILL disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, compatibility, uninterrupted access, technical outcome, rendering result, commercial outcome, production suitability, client approval, software compatibility, engine compatibility, and pipeline compatibility.

16. Limitation of Liability

To the fullest extent permitted by law, BRONXHILL is not liable for indirect, incidental, consequential, special, exemplary, punitive, or similar damages arising from use of the website, storefront, checkout, account features, digital delivery systems, product pages, previews, downloads, third-party services, or related website services.

BRONXHILL is not responsible for losses caused by software incompatibility, user workflow issues, device settings, platform outages, third-party service interruptions, payment-provider issues, user error, file handling, production delay, client rejection, or failure to review applicable product terms or license agreements.

Nothing in these Terms limits any liability that cannot be limited under applicable law.

17. Responsibility for Misuse

You are responsible for claims, losses, damages, costs, or expenses arising from your misuse of the website, your violation of these Terms, your violation of applicable law, your submission of inaccurate information, or your unauthorized use of BRONXHILL website content or digital materials.

Product-specific responsibility, remedies, and enforcement terms are governed by the applicable BRONXHILL license agreement, order record, invoice-linked scope confirmation, product term, or written approval.

18. Suspension of Website Access

BRONXHILL may suspend, restrict, or terminate access to the website, account features, checkout, downloads, or digital delivery systems if BRONXHILL determines that the website, account, order, or access has been used in violation of these Terms, applicable policies, payment obligations, or applicable law.

Suspension of website or account access does not change any separate rights or obligations contained in an applicable BRONXHILL license agreement, order record, invoice-linked scope confirmation, product term, or written approval.

19. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

These Terms apply to website access, storefront use, checkout, account access, digital delivery, product pages, and general website services.

Separate BRONXHILL license agreements, order records, invoice-linked scope confirmations, product terms, and signed written agreements control the specific products, licenses, services, transactions, and usage rights covered by those documents.

20. Changes to These Terms

BRONXHILL may update these Terms from time to time by posting a revised version on the website.

Continued use of the website after updated Terms are posted constitutes acceptance of the updated Terms, subject to any separate BRONXHILL license agreement, order record, invoice-linked scope confirmation, product term, or written approval.
